Labour Court decision in Debenhams case overturned by the High Court
The decision by the High Court holds important lessons for employers when managing collective redundancies. Employers must consider the earliest opportunity for consultation in cases of collective redundancies 'within the practicalities of life on the ground at that time'. Employees must prove that they have suffered financial loss or injury to be awarded compensation under the Protection of Employment Act 1977 (1977 Act).
